『排除が人を殺す！』　NSWP、MSMGF共同声明　エイズと社会ウェッブ版229

　エイズ終結に関する国連総会ハイレベル会合（HLM）の開幕がいよいよ迫ってきました。この会合で採択予定の政治宣言については4月にゼロドラフトが発表され、それをベースに事前の議論が進められてきました。

このゼロドラフトについてはすでに日本語仮訳も紹介してありますが、Facebookを見ていたら、5月27日に新たなドラフトが公表され、それに対してセックスワークプロジェクト国際ネットワーク（NSWP）、MSMグローバルフォーラム（MSMGF）という2つのグループが重大な懸念を表明する共同声明を出しています。その日本語仮訳です。

　要約して言うと、ゼロドラフトでは、HIV対策におけるキーポピュレーションの重要性が強調され、ゲイ・バイセクシャル男性その他の男性とセックスをする男性、セックスワーカー、薬物使用者、トランスジェンダーの人びとといったキーポピュレーションのリストも具体的に繰り返し示されていたのに、新ドラフトではごっそり削られてしまっているということです。

　残念ながら新しいドラフトは入手できていないので、ここでは共同声明から推しはかるしかないのですが、2001年の国連エイズ特別総会のコミットメント宣言でも、現在のいわゆるキーポピュレーション（当時はバルナラブルな人たちと呼ばれていた）について具体的リストを入れるかどうかでもめにもめ、結局は入れられずに、最終日にオブザーバー資格で演説を行った国際エイズ・サービス組織協議会（ICASO）のリチャード・ブルジンスキー代表が国連総会議場の壇上から、加盟国が入れられないのなら、私がここで入れようとそのリストを読み上げ、記録に残した。そんな場面があったことを思い出します。

　治療の進歩、進歩といっても、それだけでは解決しない大きな問題を世界はいまなお抱えている。今年からスタートした持続可能な開発目標（SDGs）では2030年のエイズ流行終結（ただし公衆衛生上の脅威としてのという条件付き）がHIV/エイズ分野の大目標です。

　ただし、SDGs体制出発の年における節目のハイレベル会合ですらこの状態だとすれば・・・、まさか、そんなドラフトがすんなり宣言になってしまうとは思えませんが、もしなってしまうとすれば、世界はますます前途多難であります。

　HIVとエイズに関する2016国連政治宣言に向けた新たなドラフト（草案）が5月27日に公表された。宣言はニューヨークで来週（6月8日水～10日金）最終的にまとまる予定だ。セックスワークプロジェクト国際ネットワーク（NSWP）、MSMグローバルフォーラム（MSMGF）は、HIV高速対応とゲイ・バイセクシャル男性その他の男性とセックスをする男性の人権対策に関するグローバルプラットフォーム（The Platform）とともに、多数の変更が加えられた新草案に対し、極めて強い懸念を持っている。世界のHIV対策からキーポピュレーションが消されてしまっているからだ。最終宣言は来週、HIVとエイズに関する国連ハイレベル会合で発表される予定なので、パートナーの皆さんには、国連代表団に影響を及ぼすための大胆な行動をいますぐとることを強く呼びかけたい。

　HIVはゲイ・バイセクシャル男性その他の男性とセックスをする男性、セックスワーカー、薬物使用者、トランスジェンダーの人びとに対し、若年層も含め、破壊的かつ絶望的な打撃を与えてきた。これらの集団における集中的流行は、世界のすべての国で起き、人口全体に比して、極端に高いHIV発生率と陽性率を示している。その流行は、対象となる人たちを犯罪視する法律や極端な（ときには国家の承認に基づく）暴力によって、さらに拍車がかかっている。

　公表されたばかりのドラフトの文言には、世界のHIVの流行に対する修正主義的な対応があまりにも露骨に反映されている。76のパラグラフからなる1万4000語の宣言草案の中で、男性とセックスをする男性、セックスワーカーは1回、注射薬物使用者、トランスジェンダーの人びとは2回（パラグラフ42およびパラグラフ54）しか言及されていない。

　加えて、文書全体を通じ、重要な部分で、男性とセックスをする男性、セックスワーカー、注射薬物使用者、トランスジェンダーの人びと（UNAIDS、WHO、グローバルファンドが疫学的なエビデンスに基づき、キーポピュレーションと認定）に関する言及が省かれたり、弱められたりしている。たとえば、以下のようなかたちである。

　・他のグループを付け加えて一緒にする。

　・キーポピュレーションは世界のどこでも、極端に大きくHIVの影響を受けているという事実について、限定的な言い方や不適切（かつおそらくは意図的）にぼかすような表現を使う。

　・特定の地域におけるHIVの打撃について、誤解を招き、事実に反する言い方をする。

　4月に公表されたオリジナルのゼロドラフトは、ゲイ・バイセクシュアル男性その他の男性とセックスをする男性、セックスワーカーおよび他のキーポピュレーションの間でのHIV流行に適切に対応するには、エビデンスに基づくアプローチが必要だと提言していた。だが、修正ドラフトではこの部分は消去されている。以下の重要なポイントが抜け落ちてしまうのだ。

　・キーポピュレーションがそれぞれの条件に合わせたコンビネーションHIV予防サービスを得られるようにする。

　・HIV感染や同性間の性関係、セックスワーク、薬物使用を犯罪として扱うような差別的かつ懲罰的な法律や政策を廃止する。

各国政府によるひどい行動

　HIVとキーポピュレーションに関する誤った思い込みのために、疫学的データを無視するようでは国連加盟国として嘆かわしい。議論にもならないことを議論しなければならない事態を招いていることには、（驚愕とまでは言わないが）当惑し、不安を感じる。

　世界のHIV流行に対する修正主義的な対応は断固として拒否しなければならない。男性とセックスをする男性、セックスワーカー、トランスジェンダーの人たち、注射薬物使用者らを否定するような対応は受け入れられないし、リスクの観点からしかキーポピュレーションを語ろうとしない姿勢にははっきりと反対しなければならない。私たちを無責任なコミュニティと見なす古いステレオタイプの再生に手を貸すことなどできない。だが、こうした動きが出てくることは意外なことではない。市民に服従を強い、支配し、人格を攻撃し、力を奪うためにキーポピュレーションを政治的に使おうとすることは政府にとって常套的な戦術であるからだ。アクティビストを交渉から閉め出し、国家の承認のもとでの迫害や腐敗から世界の関心をそらすための戦術としても使われることがある。

　ゲイ男性その他男性とセックスをする男性、セックスワーカー、トランスジェンダーの人たち、薬物使用者らはとくにこうした排除ブランドの対象にされやすく、大きな苦痛を受けてきた。悲しいことにHIV流行への対応を修正し、私たちのコミュニティを見えない存在にしようとする動きは、いまなお世界中の至るところにある。さらに、国家による承認のもとでの構造的な暴力は許し難いものであり、それがエイズ終結に向けた活動を妨げる結果になっている。だが、このことは、世界のHIV対策の中であまり議論されてこなかった。国家承認の構造的な暴力が文字通り私たちを殺しているのだ！　ジェネラルポピュレーションに無差別に治療薬を提供することによって、キーポピュレーションに集中している流行を抑えることができるといった考え方には強く反対しなければならない。それは目先のことしか考えない誤った発想である。

緊急の行動がいまこそ必要だ

　NSWP、MSMGFおよびThe Platformは来週、国連加盟各国代表団の関心を高めるためにニューヨークで開かれるハイレベル会合に出席する。政治宣言が最終的に、力強い言葉でゲイ・バイセクシュアル男性その他の男性とセックスをする男性、セックスワーカー、トランスジェンダーの人たち、薬物使用者の間でのHIV流行に対応するものになるよ闘う。支援者、アライの皆さんには以下のことを強くお願いする。

　1 親しい政府関係者にこうした問題に対する沈黙を破るよう働きかける。

　2 ゼロドラフトに立ち戻り、それぞれのキーポピュレーションを具体的に明示するよう主張する（「キーポピュレーション」という言葉が最初に使用された後すぐにUNAIDSとグローバルファンドが承認しているリスト―ゲイ男性その他の男性とセックスをする男性、セックスワーカー、トランスジェンダーの人たち、薬物使用者、移住者、受刑者―につなげる）。

　3キーポピュレーションに最初に言及するときには、リスクだけでなく、より広い観点から世界中でHIVの疾病負荷やスティグマ、差別、暴力などの影響を極端に大きく受けていることを述べる。

4文書全体を通し「キーポピュレーション」に繰り返し言及することの重要性を認識する。とくにHIV戦略に関するパラグラフでは重要である。また、少なくとも女性・女児の間でのHIV感染に言及するのと同じ頻度で使用する必要がある（アットリスク、ハイリスク、脆弱な集団など他のいかなる言い換えも受け入れられない）。

5性と生殖に関する健康と権利に言及するときには、必ず女性とキーポピュレーションの性と生殖に関する健康と権利とする（キーポピュレーションに常に言及するようにするためのはっきりした方策となる）

　6 コンビネーションHIV予防アプローチに包括的セクシャリティ教育を統合するよう議論する（この課題をめぐる論争は、人間のセクシャリティに関する同性愛嫌悪、女性嫌悪をめぐる議論に根ざしていることを思い返す）。

　7沈黙を破るためにソーシャルメディアのプラットフォームを使い、政治宣言に関する議論が十分になされないまま終わることのないよう進行役や交渉担当者に働きかける。

Gay men and sex workers worldwide express anger over attempts by governments to erase key populations from the 2016 UN Political Declaration on HIV and AIDS.

On May 27th, new draft language was released for the 2016 Political Declaration on HIV and AIDS, which is scheduled to be finalized in New York City next week (Wednesday, June 8 to Friday, June 10) at the United Nations. The Global Network of Sex Work Projects and MSMGF (The Global Forum on MSM & HIV) together with the Global Platform to Fast-Track the HIV and Human Rights Responses Among Gay and Bisexual Men and Other Men Who Have Sex with Men (The Platform) are deeply concerned with numerous changes made in the new draft, which erase key populations from the global HIV response. As the final political declaration will be issued during next week’s United Nations High-level Meeting on HIV and AIDS, we urge our partners to take bold and fast actions now to influence decisions made by UN delegation members.

HIV is having a devastating and disparate impact on gay and bisexual men and other men who have sex with men, sex workers, people who use drugs, and transgender people including young people of these populations. Concentrated HIV epidemics in these groups occur in all countries worldwide as evidenced by disproportionately high HIV incidence and prevalence when compared to the general population. Uncontrolled epidemics in these group are exacerbated by criminalization and extreme (in some instances, State-sanctioned) violence.

These facts stand in stark contrast with what amounts to a revisionist characterization of the global HIV epidemic within the draft language just released. In a 14,000-word document that includes over 76 discrete points, men who have sex with men; sex workers are only mentioned; people who use and/or inject drugs; and transgender people are only mentioned in twice (in Paragraphs #42 and #54).

In addition, critical references to men who have sex with men, sex workers, people who inject drugs, and transgender people (recognized by UNAIDS, WHO, and the Global Fund to be key populations based on global epidemiological evidence) have been removed or weakened throughout the document. Examples of this include:

・Adding or combining other groups;

・Introducing qualifier language, inaccurately (and perhaps deliberately) obscuring the fact that key populations are disproportionately affected by HIV everywhere in the world; and

・ Using misleading and factually incorrect statements about the HIV burden in specific regions.

The original Zero Draft released in April recommended evidence-based approaches needed to adequately address the HIV epidemic among gay and bisexual men and other men who have sex with men, sex workers, and other key populations. These were deleted in the revised draft. These included important points related to:

・Ensuring access to tailored HIV combination prevention services for key populations; and

・Repealing discriminatory and punitive laws and policies, such as those related to criminalization of HIV transmission, same-sex sexual relations, sex work and drug use.

Bad Behavior By Governments

It is deplorable that the UN Member States can choose to overlook epidemiological data on key populations in favor of bogus beliefs about HIV and about key populations. We are dismayed and disturbed (if not surprised) that we find ourselves, yet again, in debates about issues that aren’t and shouldn’t be debatable!

We emphatically reject revisionist characterizations of the global HIV epidemic. We do not accept negative characterizations of men who have sex with men, sex workers, transgender people, and people who inject drugs, and we certainly disagree with the idea that key populations are only worthy of mention in the context of discussions about risk – especially since it reinforces old stereotypes about our communities as being irresponsible. We are not surprised by these actions because using key populations as a political wedge is a routinely employed tactic by governments to subjugate, oppress, debase, and belittle its citizens. These are also tactics deliberately used to throw activists off their game and to distract global attention away from State-sanctioned abuses and corruption.

This brand of exclusion has particular and painful salience for gay men and other men who have sex with men, sex workers, transgender people, and people who use drugs. It is sadly still too common to have our communities rendered invisible in revisionist characterizations of the HIV epidemic worldwide. Moreover, the relative absence in global HIV discourse about State-sanctioned structural violence is reprehensible and undermines the possibility of progress in our work to end AIDS. State-sanctioned structural violence is literally killing us! We must forcefully resist the idea that indiscriminately throwing pills at the general population will somehow reverse concentrated HIV epidemics in key populations. This is idea is shortsighted and misguided.

Urgent Action Needed Now!

NSWP, MSMGF and the Platform will be represented at the High-level Meeting in New York City next week to raise these concerns with UN country delegations. We will fight to ensure that the final political declaration includes stronger language addressing the HIV epidemic among gay and bisexual men and other men who have sex with men, sex workers, transgender people, and people who use drugs. We strongly encourage advocates and allies to:

1 Ask that friendly governments break their silence on these issues;

2 Insist that key populations be specifically named upfront in the document, reverting to earlier language, which was more palatable (the first use of the term ‘key populations’ should be immediately followed by the list as endorsed by UNAIDS and the Global Fund – gay men and other men who have sex with men, sex workers, transgender people, people who use drugs, migrants and prisoners);

3 The first reference to key populations should not solely be couched in discussions about risk but more broadly cast in factual discussions about disproportionate HIV disease burden, stigma, discrimination, and violence worldwide;

4 Maintain the importance of referencing the term “key populations” consistently throughout the document, especially in paragraphs concerning strategies for responses to the HIV epidemic and with at least the same frequency used when referring to HIV among women and girls (any other euphemism, e.g., at risk, high risk, vulnerable groups, is unacceptable);

5 Push to retain language concerning sexual and reproductive health and rights of women AND key populations (one of the obvious ways we can ensure the more consistent referencing of key populations);

6 Argue for integrating comprehensive sexuality education into combination HIV prevention approaches (remember: the contestation of this issue is squarely rooted in homophobic and misogynistic ideas about human sexuality); and

7 Use your social media platform to break the silence and stop facilitators and negotiators from prematurely closing discussions about the political declaration.
